(Alliance News) - Nanoco Group PLC on Friday said the court has finally placed the case with Samsung Electronics Co first in the trial schedule, after multiple delays.

Nanoco shares were up 9.8% at 41.70 pence each on Friday morning in London, while Samsung shares rose 2.0% to KRW60,400.00 each in Busan on Friday afternoon.

Nanoco, a Manchester-based quantum dots manufacturer said it now expects to go to trial on January 6 next year against South Korean electronics company Samsung.

Chief Executive Officer Brian Tenner said: "There are now no administrative or legal hurdles to the trial going ahead. Assuming no settlement or other unforeseen event, we now expect to go to trial on 6 January 2023. We have maintained our team of witnesses and advisers in a high state of readiness for the last few months and this will continue until the trial is complete. We still expect that the trial will last five working days and therefore expect the jury to return a verdict around January 12, 2023."

Nanoco added that as is the usual practice, the court has scheduled a number of trials for the same date given that, historically, the majority of cases settle before trial. However, the fact that the Nanoco trial has been set first in the schedule, means that it is not dependent on other cases settling in order to proceed.

Back in February 2020, Nanoco filed a patent infringement lawsuit against South Korean electronics giant Samsung Electronics Co in the US District Court for the Eastern District of Texas.

The lawsuit claimed infringement of Nanoco's unique synthesis and resin capabilities for quantum dots. Quantum dot technology is used on Samsung QLED televisions. QLED stands for quantum light-emitting diode.

In May, the US Patent Trial & Appeal Board ruled in favour of the company's patent claims against Samsung. Then, in an August pre-trial conference, Nanoco said that it was in a "strong position" ahead of the trial.

The trial against Samsung was initially scheduled to start on September 12, and was then delayed multiple times.
